He has acted in litigated and unlitigated medical negligence claims in the Supreme and County Courts of Victoria and been involved in claims involving complex liability and causation issues, wrongful death and multi-party proceedings.
Jeremy has an established practice of instructing in major complex coronial matters on behalf of primary health care organisations including acting for employee doctors, nurses and senior executive clinical staff. Many of these inquests have involved significant levels of media scrutiny.
- Acted in a Supreme Court proceeding involving alleged mismanagement of a perforated GI ulcer resulting in a patient’s death. Obtained supportive breach and causation opinions. The Plaintiff withdrew the claim and bore their own costs pre-mediation.
- Defended a multi-party Supreme Court claim involving alleged failure to detect breast cancer. Appeared at mediation and secured a favourable outcome, leveraging expert evidence and resolving contribution beforehand.
- Acted in a complex multi-party claim involving alleged failure to obtain informed consent and miscommunication of a sexual assault. Claims by mother and daughter for psychiatric injury required thorough factual investigation and expert analysis to isolate pre-existing conditions.
- Represented a nursing/admin services provider in a County Court claim involving an epidural abscess post-procedure. Contribution was resolved favourably at mediation, with the claim settling shortly before trial.
- Acted for a dentist in a multi-defendant Federal Court sexual harassment claim.
- Defended a County Court nervous shock claim following a prison suicide. Resolved contribution and achieved favourable outcome for defendants.
