Eilish is an experienced litigator with expertise in general liability and professional indemnity claims. Eilish acts for a range of clients in the insurance, finance and professional services sectors. She has broad experience in acting for clients in the defence of professional negligence, personal injury, TPD, death and income protection claims, as well as advising clients in relation to issues of indemnity, policy response, and insurer and trustee duties which often arise in those contexts.

Eilish develops effective and commercially astute claims management strategies for both litigated and non-litigated claims in line with her clients’ business objectives. As a keen advocate, well-versed in court procedure, Eilish is experienced in appearing on contested interlocutory, ancillary and directions hearings across the various courts and tribunals of the NSW and Federal jurisdictions.

Eilish was a finalist in the Lawyers Weekly 30 Under 30 Awards for Insurance in 2020.

  • Successfully opposing, by way of written submissions, orders for personal costs sought against a firm of solicitors in the NSW Court of Appeal.
  • Successfully opposing proceedings, and a subsequent appeal, alleging breaches of consumer law against a solicitor in the NCAT, resulting in the proceedings being dismissed with costs ordered in the solicitor’s favour.
  • Assisting clients in achieving favourable resolution of proceedings through various ADR means.
  • Advising and acting for the trustee of a superannuation fund in the defence of claims of breaches of trustee and equitable duties in relation to death, TPD and income protection claims.
  • Advising insurers on policy wording and response.
