Nadica specialises in professional indemnity matters focusing on professionals within the construction, environment, and property space. She acts for local and overseas-based insurers in providing coverage advice and defence of litigated claims for a range of insured professionals including solicitors, barristers, engineers, certifiers, real estate agents, property consultants, financial planners and brokers. She is also experienced in defending professionals in disciplinary proceedings and complaints from professional bodies.   

Nadica is committed to delivering the best commercial outcomes for clients and is skilled in implementing strategies to deliver those results. Having previously worked in-house at Allianz and completing a secondment at AIG, Nadica is experienced in understanding the needs and priorities of insurers.   

Nadica has a keen interest in contributing to pro-bono projects. She has previously completed an internship in Paris within a Pro-bono division of a law firm and has assisted various community legal centres in providing general legal advice.  

Professional Indemnity

  • Acting on behalf of a barrister in appealing a disbarment in the Court of Appeal with regard to challenging findings of professional misconduct relating to alleged tax failures and fraud and whether there was a reasonable excuse.
  • Successfully defending a barrister at trial in the District Court of NSW with respect to allegations of negligence by the barrister’s former clients.
  • Acting on behalf of a barrister in responding to a complaint and in disciplinary proceedings brought by the NSW Bar Association at NCAT with regard to allegations of unsatisfactory professional misconduct and professional misconduct.
  • Acting on behalf of solicitors and a law firm in Federal Court of Appeal proceedings to challenge allegations of misconduct and the competency of the appeal.
  • Representing an engineering firm and its insurer in multi-party proceedings brought by the owners and tenants of neighbouring properties to a construction site. The plaintiffs suffered cracking and other damage to their buildings. Nadica instructed counsel in the trial in the Supreme Court of NSW.

Environmental Liability and Property Damage

  • Acting as coverage counsel for insurers with respect to environmental and statutory liability arising out of pollution incidents, including claims by regulators and third parties. The claims exceed $1M.
  • Acting for a local insurer and their insured in a recovery action against a contractor for costs relating to flood damage to property and items owned by third-parties in a commercial storage warehouse.
  • Acting for an insurer in a recovery action regarding damage to a commercial premises from a fire caused by welding works. Proceedings were issued against a contractor, occupier, and the occupier’s insurer under s 5 Civil Liability (Third Party Claims Against Insurers) Act who had denied indemnity to the occupier, and the occupier was being deregistered.

General liability/Casualty

  • Defending various construction contractors including formworkers, building consultants, and electricians, on building projects with regard to workplace incidents and injuries and alleged breaches of duty of care under contract and negligence.
  • Successfully defending a claim at trial in the Supreme Court of NSW involving allegations that a motorcycling track was improperly designed or maintained and caused a participant to sustain a catastrophic injury.
