Thomas, who has worked in both New Zealand and the UK, practises across a range of insurance areas, including professional indemnity, general liability, statutory liability and subrogated recoveries, has defended claims against insured professionals, including negligence claims against solicitors and claims in multi-party construction litigation against architects and engineers. Thomas has experience in the statutory liability space, including coverage advice for Environmental Impairment claims, and sentencing for insured clients prosecuted by WorkSafe New Zealand. He has assisted with several successful subrogated recoveries, including property damage claims, and contaminated goods claims involving costly product recalls. Thomas takes a commercial approach to his work, focusing on helping insurers achieve a cost-effective result.

  • Defending professional negligence claims brought against engineers and architects in multi-party defective building claims, including failed remediation claims following the Canterbury earthquakes.
  • Advising on, and assisting with, the defence of contractors, including High Court litigation in the environmental and agricultural impairment area.
  • Defending insured clients, including in the agricultural sector, facing statutory prosecution, including the defence of RMA and WorkSafe prosecutions.
  • Pursuing subrogated recovery claims for insurer clients, including cases where commercial businesses were faced with contaminated products.
