Samantha specialises in medico-legal and professional indemnity matters. She also has extensive experience in general civil and commercial litigation, and judicial review.

Samantha has frequently appeared in disciplinary tribunals for medical practitioners, lawyers, accountants and teachers. She is a strong advocate for members of a large health practitioner indemnifier who require assistance with inquiries and regulatory investigations in discipline, privacy, human rights, criminal and ACC matters.

She has also appeared as junior counsel, including alongside a distinguished Queens Counsel, in both trials and appeals at the District Court, High Court and Court of Appeal levels. These have covered a wide array of issues, including construction, local government, defamation, wills and estates, product liability and contracts.

Medico-legal

  • Regularly advising members of the Medical Protection Society on a wide range of healthcare, medico-legal and disciplinary law issues, with regular court appearances – including before the Health Practitioners Disciplinary Tribunal and High Court.
  • Representing a pharmacist in a successful High Court appeal of the Health Practitioners Disciplinary Tribunal’s decision to cancel the pharmacist’s registration.
  • Acting for a general practitioner in an appeal to the High Court, successfully overturning the Health Practitioners Disciplinary Tribunal’s adverse finding on liability and name suppression.
  • Acting for a physiotherapist in successfully defending a charge of dishonesty before the Health Practitioners Disciplinary Tribunal.
  • Assisting a dentist in avoiding a charge of professional misconduct when faced with a Professional Conduct Committee investigation following a physical altercation with a colleague.

Professional indemnity

  • Acting for an accountant from a top tier accounting firm regarding a disciplinary charge, including before the New Zealand Institute of Chartered Accountants Appeals Council and in a successful judicial review regarding the issue of name suppression.
  • Representing a lawyer in multi-faceted litigation arising from misleading the Overseas Investment Office regarding a client’s purchase of sensitive land.

Commercial litigation

  • Representing two homeowners regarding concerns about weatherboards installed on their property. Causes of action in negligence and under the Consumer Guarantees Act were brought, involving complicated technical evidence around timber and paint defects.
