Miles acts for clients as junior and senior counsel across a wide range of dispute resolution platforms, including in the District and High Courts, the Court of Appeal, the specialised Māori Land Court and Family Court, as well as in various alternative dispute resolution methods such as arbitration, adjudication, mediation and judicial settlement conferences.  

Miles has acted for a wide variety of clients from insurers, large construction and infrastructure companies, and territorial authorities, to individual personal or closely held corporate private clients on a wide range of complex disputes.   

Miles has a particular expertise in construction, corporate and regulatory disputes and has assisted clients bringing and defending large infrastructure and corporate claims.  Miles has also assisted infrastructure and construction clients with regulatory compliance and crisis management.  As a member of the Cyber, Privacy + Data Security team at Wotton Kearney, he uses this experience to assists insurers and their insureds with crisis management in relation to data breaches and advises on potential statutory, regulatory, and civil liability arising from those breaches. 

  • Advising two large and reputable construction companies on compliance with a regulator for potential regulatory breaches under the Resource Management Act and relevant regional plans. 
  • Successfully assisting on the defence and negotiated settlement of a major arbitrated infrastructure dispute involving allegations of defective workmanship and design, extensions of time, liquidated damages, buildability and questions of design liability.  
  • Engaging and briefing expert witnesses on complex construction and infrastructure disputes to heavy machinery fire investigations. 
  • Assisting with the defence of arbitrated and adjudicated claims with considerable monetary liability and reputational risk to large construction and infrastructure clients.  
  • Assisting and advising insureds on liability and negotiated settlement of defective earthquake repairs and unidentified/unrepaired damage to domestic dwellings. 
  • Successfully assisting in negotiating settlements (following the bringing and continuation of proceedings in Courts or arbitral tribunals) for a large commercial and infrastructure equipment provider across multiple disputes. 
  • Successfully acted for a homeowner in an adjudicated claim against her builder for defective workmanship, resulting in a payment to the homeowner in the amount found needed to repair the defective workmanship. 
  • Advising and representing territorial authority in relation to their rights to issue a warrant for the demolition of dangerous buildings and recovery funds under the Building Act and successfully representing the same to confirm that warrant in the District Court following completion of the demolition works. 
  • Successfully acting for a large property subdivider for the removal and modification of covenants over land in the High Court, allowing a large subdivision to progress.
