Madeleine specialises in financial lines insurance with a focus on professional indemnity and directors & officers liability. Madeleine’s experience primarily involves defending claims against professionals including solicitors, accountants and construction professionals, in which Madeleine regularly appears in the Supreme and District Courts of NSW.

In addition to her experience in litigation and dispute resolution, Madeleine also has experience in representing financial institutions and other companies in regulatory investigations and public inquiries, reviewing and drafting policy wording, and advising on coverage. She is committed to delivering the best commercial outcomes for her clients.

Madeleine has spent time on secondment at a global insurer in its general insurance division, as well as with a national professional indemnity insurer as a claims solicitor.

  • Acting for a global financial services group, including a superannuation trustee and related Australian financial services licensee, in an ASIC investigation into fees for no service.
  • Acting for a former officer of The Star Pty Ltd in relation to Adam Bell SC’s independent review of the company.

Professional Liability

  • Acting for a law firm in $30 million proceedings commenced in the Supreme Court of NSW in which it was alleged it breached trust, contract, and was negligent by paying out funds held in trust to a fraudster.
  • Acting for a consultant engineering company (and its London-based insurer) subcontracted to design an airfield pavement in relation to a $25 million arbitration commenced against it by the managing contractor of the project alleging negligent design.
  • Acting for a law firm in $8 million proceedings commenced in the Supreme Court of NSW in which it was alleged the firm was vicariously liable for the conduct of one of its employees, who defrauded a bank and client.
  • Acting for an accounting firm (and its London-based insurer) in relation to $5.5 million proceedings commenced against it by a bank alleging it was negligent and involved in the misleading and deceptive conduct of one of its clients.
  • Acting for a law firm in $3 million proceedings in the Supreme Court of NSW in which it was alleged the firm failed to draft an appropriate security interest clause or register a security interest on the PPSR.
  • Acting for a law firm in relation to a franchise class action commenced against it in the Supreme Court of NSW, where allegations included that the firm was involved in the misleading and deceptive conduct and franchise code breaches of its franchisor client.
