Kristyn is experienced in advising and acting on subrogated recoveries, building and construction disputes, commission claims, shareholder disputes, restraints of trade, rent roll disputes, commercial and residential contract disputes, and general debt recovery matters.

Admitted to the Supreme Court in 2016 and to the High Court in 2017, she has also completed a Master of Laws, majoring in commercial litigation.

Property and Construction

  • Acting for insurers on a $52 million subrogated recovery in Victoria involving a flashover event in a desalination plant. Kristyn’s work included managing an extensive discovery process containing over 200,000 documents.
  • Acting for insurers on a $200 million subrogated recovery in Queensland involving a highway failure due to defective groundworks.
  • Providing insurers with coverage advice under a Contract Works Material Damage Policy in respect to a significant rain event which resulted in water ingress to a school construction project, causing approximately $3 million in damage.
  • Advising the owners of a $25 million commercial property on a dispute in relation to the commission entitlements of the real estate agents and acting in the NCAT proceedings, ultimately settling the matter.
  • Advising the lot owner of a $7 million property in relation to a claim against the Owners Corporation for failure to maintain and repair common property causing damage to the lot owner.
  • Advising the owners of a large commercial property in relation to defective work undertaken by building contractors and obtaining an adjudication award in the client’s favour.

Employment and Shareholder Disputes

  • Advising the trustees of a unit trust in relation to defending a claim against a unit holder alleging an invalid forfeiture of units and acting in Supreme Court proceedings.
  • Advising an employer in relation to a claim against former employees for breach of contract and misuse of confidential information, including acting on obtaining urgent injunctions to restrain each employee against further breaches.
