Katie Kyung is a Senior Associate in the Cyber, Privacy and Technology team at Wotton Kearney, with a particular focus on technology disputes.

She advises both local and international insurer clients and various insureds (MSPs, software developers, and SaaS providers) across all aspects of technology liability, including breach of contract, negligence, and Australian Consumer Law claims. She has also supported clients across all aspects of cyber incident response, including breach assessment, data security, as well as advising clients on privacy policies to ensure compliance with relevant obligations.

Drawing on her background in commercial litigation, Katie is adept at unpacking complex disputes to provide clear and strategic advice that supports efficient and commercially sound outcomes that are aligned with each client’s goals. She has represented clients not only before the Court of Appeal, but also in alternative dispute resolution forums, including mediations and settlement conferences.

Katie’s experience ranges across a variety of sectors, including corporate, government, as well as a secondment with an insurance broking firm, equipping her with a strong understanding of the commercial objectives and stakeholder dynamics unique to each environment.

  • Acting for a non-profit organisation in response to a significant cyber incident, advising on breach assessment, stakeholder management, and compliance with privacy obligations. Assisted in obtaining a court injunction to prevent further dissemination of sensitive data.

  • Acting for a global marketing client in a dispute involving breach of contract, negligence, and consumer law claims. Advised on mediation strategy and engaged expert evidence to support a successful early-stage settlement.

  • Acting in a complex construction dispute appeal, preparing affidavits and submissions that contributed to the court overturning a prior decision.

  • Supporting clients in trade credit insurance proceedings, assisting with discovery management and coordination of interlocutory applications, contributing to efficient case progression in federal court.

  • Acting in a Court of Appeal matter in New Zealand, preparing affidavits and submissions that contributed to a successful outcome. Leveraged multilingual skills to ensure effective client communication.
