Jennifer is a construction and infrastructure specialist, focusing predominantly on mining, building and construction disputes. She has extensive experience in managing high-profile and high-value domestic and international arbitrations, and multi-jurisdictional Australian Supreme Court proceedings for large construction companies.

Jennifer has over 15 years’ experience as a litigation lawyer across a variety of disciplines, including commercial, building and construction, insurance, occupational health and safety, and employment litigation.

She is experienced in preparing and defending adjudication applications under security of payments legislation, including appeals against enforcement. She is also experienced in Supreme Court interlocutory applications for injunctions to prevent unlawful access to bank guarantees.

Jennifer is admitted to practice in the Supreme Court of New South Wales, Supreme Court of Western Australia and the High Court of Australia. She is a member of the National Association of Women in Construction (NAWIC) WA chapter.

Construction and Infrastructure

  • Acting for a structural engineer in a $25 million+ multiparty dispute regarding property damage arising from a design and construct contract to upgrade a large WA aquatic centre.
  • Acting for a construction contractor in upstream and downstream disputes of $120 million regarding the upgrade of a wastewater treatment plant in a domestic arbitration and in the Supreme Court of Queensland.
  • Working on a 10-month secondment to John Holland (Perth) to assist the in-house legal team with various disputes, which involved arbitration, expert determination, and litigation.
  • Acting for a defendant contractor in a $3 billion arbitration in a $46 billion LNG project in Darwin, in the Singapore International Arbitration Centre, and in related Supreme Court proceedings to enforce parent company guarantees.
  • Acting for a construction contractor in defending $12 million Supreme Court of WA proceedings, and expert determination, regarding a bulk earthworks and drainage dispute with a subcontractor relating to the NorthLink WA Tonkin Highway extension.
  • Acting for a construction contractor in a $20 million dispute regarding delays and defects in the supply, installation, commissioning and testing of an advanced technology package at a $1.2 billion Perth hospital.
  • Acting for a contractor in preparing a $200 million arbitration in the Singapore International Arbitration Centre regarding the Roy Hill Project, and in Supreme Court of WA appeal proceedings to enforce $60 million adjudication determinations, as well as applications for urgent injunctive relief.
  • Acting for a contractor in multijurisdictional proceedings in the Supreme Courts of New South Wales, Queensland and Victoria, and in the District Court of Western Australia, regarding the construction of a $30 million Queensland mine site accommodation village and related subcontractor disputes.

  • Defending and advising on WorkSafe investigations and prosecutions, including fatalities, emergency incident response and management, and assisting clients to audit and change occupational health and safety systems.
  • Advising top-tier mining clients, including Rio Tinto, Woodside, Barrick Gold and Hamersley Iron, on civil liability, occupational health and safety legislation, insurance and risk management, and workers compensation.
  • Providing strategic and legal advice on industrial relations and employment law, including industrial action, unfair dismissals, performance management and terminations.
  • Advising on corporate change of control transactions, workforce restructures, redundancy and retention bonuses.
