James advises clients on a wide range of legal issues. He has extensive experience in litigation, particularly involving commercial disputes, building and construction projects, financial services, insurance, and professional negligence. In addition, James also acts for clients in regulatory and government inquests, commissions of inquiry and investigations, and has a detailed understanding of ASIC, AFCA and ACCC investigations and how to respond to and conduct these strategically.
In addition to being a defence specialist, James is experienced in providing coverage advice for insurers and their insureds. In terms of coverage, James has a breadth of experience in advising on complex coverage issues (both litigious and non-litigious) for primary and excess insurers, with a particular focus on warranty & indemnity, management liability and financial institutions claims.
- Acting for Coles Supermarkets in the successful defence of NSW Supreme Court proceedings seeking damages arising from an alleged breach of a supermarket lease – Macquarie Publications Pty Ltd v Coles Supermarkets Australia Pty Ltd [2021] NSWSC 405.
- Acting for a substantial manufacturer in the successful opposition to an application for an urgent injunction in proceedings alleging misuse of confidential information – Howden Australia Pty Ltd v Minetek Pty Ltd [2019] FCA 981.
- Acting for a firm of tax advisors in successfully defending proceedings brought in the Supreme Court of NSW by a client in relation to tax advice – Hampshire Assets and Services Pty Ltd v Blackman [2018] NSWSC 1096.
- Acting for a firm of accountants in successfully defending proceedings in respect of alleged professional negligence and breaches of contract – Inline Partners Pty Ltd v Hadden [2023] NSWDC 273.
- Acting for a Queens Counsel in successfully having proceedings alleging professional negligence and breaches of contract dismissed with costs – Westwood v Gulliver & Ors [2024] NSWSC 1323.
