Emily has a particular focus on professional liability, D&O liability and financial institutions. She has extensive experience advising Australian and London insurers on complex, high-value coverage matters, monitoring claims and advising on strategy to resolve coverage disputes. Her experience includes advising insurers on class actions against directors and officers, as well as against financial institutions involving regulatory investigations.
She also has experience in defending professionals in the financial lines sector. She has acted in matters before the District Court, Supreme Court and Federal Court of Australia in the jurisdictions of New South Wales and Victoria.
Emily has completed several secondments within the Australian insurance market, where she gained experience advising insurers on policy coverage issues emanating from claims and investigations brought in various jurisdictions.
- Acting in some of Australia’s largest, most complex, and most recent class actions. The class actions are well-known to the market and involve complex coverage issues, given the dynamics between the insurance towers, the changing landscape of the Australian class action regime, and technical expert evidence.
- Acting for a firm of accounting partners in a complex accounting and taxation matter in the Supreme Court Professional Negligence List. The claim involves detailed consideration of complex alternative corporate taxation structures and the implications of those structures.
- Acting for a primary insurer in a claim for indemnity by an investment manager who is the responsible entity of two large funds.
- Acting for first excess layer co-insurers in a claim for indemnity by an investment and wealth management firm.
- Acting for three London insurers in a claim for indemnity by an Australian superannuation fund regarding a claim brought by ASIC in the Federal Court of Australia. The claim involved a remediation scheme and ASIC sought penalties in excess of $12 million against the insured for providing members with misleading information about their insurance.
