Rakhee specialises in technology and data law and has extensive experience in data privacy law and cyber resilience projects, including privacy compliance and cyber incident and data breach preparedness. She also has experience in telecommunication and media law, technology transactions, integration projects, and advertising and social media regulation.
Rakhee has more than 10 years’ experience across both Australia and South Africa and has worked with clients in various industry sectors including TMT, financial services, consumer goods and retail, healthcare, and transport.
Rakhee is a thought leader in the technology and data law space and has been recognised as an Up and Coming lawyer in IT and Telecommunications in the Chambers Global Guide 2022. She was also named a leading author and Lexology Legal Influencer for TMT in Africa and the Middle East (Q1 2021, Q4 2021, Q1 2022, Q2 2022), as well as a thought leader for Data Protection in South Africa in the Mondaq Thought Leadership Awards, Autumn 2021.
- Assisting a US-based technology company with responding to an RFP issued by a government entity and coordinating the review of extensive contractual and subcontracting arrangements.
- Advising a multinational FMCG company with the contracting of a new multi-jurisdictional outsourcing contract, assisting the client with the RFP phase, including negotiations with the down-selected vendors, drafting of the MSA and SOWs, and negotiations with the selected vendor.
- Representing an Indonesian nickel mining company in the drafting and negotiation of various transaction documents representing a partnership with a battery mineral production company and an automaker. The negotiations involved Australian, US, UK, Indonesian and Chinese counterparts, with in-person negotiations in Jakarta and Dubai.
- Assisting a major financial institution with the drafting and negotiation of the single largest outsourcing transaction in its history, involving 15 countries across Africa, a term of at least 10 years, and a quantum in excess of R$10–12 billion.
- Assisting a prominent social media provider in respect of responding to requests for information and allegations of non-compliance with the Protection of Personal Information Act by the Information Regulator of South Africa. This was a ground-breaking matter and the first of its kind in South Africa, drawing intense media scrutiny.
